1. Acceptance
By creating an account or using MoxMarket, you agree to these terms and our Privacy Policy. If you do not agree, you must not use the platform. These terms are governed by the laws of New Zealand. The Consumer Guarantees Act 1993 and Fair Trading Act 1986 apply to sellers making consumer sales — these rights cannot be excluded by these terms.
2. User conduct
You are responsible for all activity on your account. You must not use MoxMarket for fraud, misrepresentation, or any activity that violates New Zealand law. Prohibited listings include counterfeit or proxy cards represented as genuine, stolen goods, and any item whose sale is illegal in New Zealand. Attempting to circumvent platform fees (e.g. by directing buyers off-platform after initial contact) is a breach of these terms and may result in account suspension.
3. Listings
Sellers are responsible for the accuracy of their listings. Cards must be graded honestly and conservatively using the condition grades shown on the platform. Items must match their description and images at the time of sale.
Sealed product and bulk lot listings (“manual listings”) are submitted for review and will not go live until approved by MoxMarket. MoxMarket reserves the right to decline, remove, or delist any listing that violates these terms or applicable law, without prior notice.
Sellers who hold a verified business badge have completed MoxMarket’s business verification process. The badge reflects completion of that process only — it does not constitute an endorsement or guarantee by MoxMarket of the seller’s products or conduct.
4. Seller obligations
By listing on MoxMarket, sellers agree to:
- Post items within 5 business days of a confirmed sale.
- Grade cards honestly and conservatively.
- Respond to buyer contact within 72 hours.
- Resolve legitimate disputes in good faith.
- Keep their account details accurate, including bank account number and any Stripe Connect information.
- Maintain their Stripe Connect account in good standing if they have enabled card payments. Sellers are responsible for any Stripe compliance requirements applicable to their account, including identity verification.
- Pay all outstanding platform fees promptly.
5. Transactions and payments
MoxMarket facilitates transactions between buyers and sellers but is not a party to any sale. Each sale is a direct contract between buyer and seller. MoxMarket’s role is limited to providing the marketplace infrastructure.
Bank transfer
When a buyer selects bank transfer, they pay the seller’s nominated bank account directly using the order reference code. MoxMarket does not handle or verify bank transfer funds. Buyers who have paid should mark the order as paid; sellers who have received payment should ship promptly. Bank transfer payments have no buyer protection beyond these terms and the seller’s legal obligations.
Card payment via Stripe
When a buyer pays by card, the payment is processed by Stripe. The card processing surcharge (displayed at checkout) is charged to the buyer and covers Stripe’s processing fee. The net sale amount — after the platform fee is deducted — is credited to the seller’s MoxMarket wallet.
Seller wallet
Card payment proceeds are held in the seller’s Stripe Connect account (the “wallet”) until the seller initiates a withdrawal. Withdrawals are sent to the seller’s nominated bank account by Stripe. A $2.00 NZD withdrawal fee is deducted from each withdrawal request. MoxMarket is not responsible for delays by Stripe in processing payouts. Wallet balances do not earn interest. MoxMarket may freeze a seller’s wallet in response to suspected fraud, a chargeback, or at Stripe’s direction.
Chargebacks
If a buyer initiates a chargeback with their card issuer, Stripe will open a dispute process. The seller is responsible for providing evidence to defend the chargeback. Any amount reversed by a chargeback — including any chargeback fee levied by Stripe — will be debited from the seller’s wallet or added to their outstanding balance. MoxMarket will assist sellers with dispute evidence where reasonably possible, but cannot guarantee chargeback outcomes. Sellers who experience a high rate of chargebacks may have card payments disabled on their account.
6. Fees
Listing on MoxMarket is free up to the limit for your plan. A platform fee is charged on each completed sale. Fees are subject to change with 30 days’ notice communicated by email or platform notice.
Transaction fees (effective May 2026)
- Free plan: 3% of the sale price
- Subscriber plan: 2.75% of the sale price
- Trade plan: 2.5% of the sale price
Boost fees
Sellers may boost listings for priority placement. A boosted listing that sells incurs the seller’s standard tier rate plus a $2.00 flat fee. Sellers with monthly boost credits (included in Subscriber and Trade plans) may apply a credit to reduce the fee back to their standard tier rate. Boost credits expire at the end of each monthly billing cycle and do not roll over.
Card payment surcharge
Card payments carry a buyer-paid surcharge to cover Stripe’s processing costs. The surcharge is displayed to the buyer before checkout confirmation and does not affect the seller’s proceeds.
Withdrawal fee
A $2.00 NZD fee is deducted from each seller wallet withdrawal. This fee covers the costs of Stripe’s Connected Account monthly fee and payout processing.
Outstanding balance and account enforcement
Platform fees on bank transfer orders accrue as an outstanding balance, collectible by bank transfer using your account reference. New listings are paused when your outstanding balance reaches the threshold for your plan ($10 Free, $25 Subscriber, $100 Trade) and has been unpaid for 7 days. Accounts suspended for non-payment are restored automatically when the balance is cleared. Persistent unpaid fees may be referred to a debt collection agency. GST may apply to platform fees once MoxMarket’s revenue reaches the NZD $60,000 registration threshold under the Goods and Services Tax Act 1985.
7. Subscriptions
Paid subscriptions (Subscriber and Trade plans) are billed monthly via Stripe. You may cancel at any time and will retain access to your plan benefits until the end of your current billing period. On cancellation or expiry, your account reverts to the Free plan. If your active listing count exceeds the Free plan limit at that time, existing listings remain live but you will be unable to add new listings until you are within the limit. Subscription fees are non-refundable except where required by law.
8. Dispute resolution
MoxMarket is a marketplace — we are not the seller and do not guarantee refunds. We take disputes seriously and will act against sellers who repeatedly fail buyers.
Step 1 — Resolve directly (72 hours)
When an issue arises, the buyer must first contact the seller directly via the order page. Both parties have 72 hours to reach an agreement. Common resolutions: the seller provides tracking info or confirms postage (item not received); the seller offers a partial refund or return (condition worse than listed); the seller arranges return and replacement at their cost (wrong item sent).
Step 2 — Escalate to platform (after 72 hours)
If unresolved, either party may submit a report with the Order ID, a description of the issue, and supporting evidence (photos, messages). MoxMarket will review and may issue a warning, temporarily suspend the seller’s listing ability, or permanently ban repeat offenders. Disputes must be raised within 30 days of the order completion date.
Step 3 — Platform decision
Platform decisions are final within the scope of the platform. MoxMarket does not issue financial refunds. Buyers seeking financial recourse should contact their bank directly (for bank transfers — note no buyer protection applies) or initiate a chargeback with their card issuer (for card payments). Three upheld complaints against a seller within any 6-month period will result in permanent account suspension.
Card condition grading is subjective. MoxMarket does not arbitrate NM vs LP disputes — seller ratings are the primary protection. Repeated condition complaints will trigger an admin review.
9. Intellectual property
MoxMarket is not affiliated with or endorsed by Wizards of the Coast, The Pokémon Company, Bandai, or any other card game publisher. Card names, set names, and artwork are the property of their respective owners and are used for identification purposes only. By uploading images to MoxMarket, you grant us a non-exclusive, royalty-free licence to display and reproduce those images on the platform for the purpose of facilitating your listing. This licence ends when the listing is removed or your account is deleted.
10. Account termination
You may delete your account at any time via Settings. Any wallet balance remaining at account deletion will be subject to a final withdrawal; if a withdrawal cannot be completed, the balance is forfeited. Outstanding fees remain payable after account deletion.
MoxMarket may suspend or terminate accounts that violate these terms, engage in fraudulent activity, accumulate upheld dispute complaints as described above, or fail to maintain a Stripe Connect account in good standing. On termination, active listings will be cancelled and pending orders will be marked for resolution.
11. Third-party services
MoxMarket uses third-party services including Stripe (payments and seller KYC), Supabase (database and authentication), Resend (email), Cloudflare R2 (image storage), and Vercel (hosting). Your use of card payments and seller payouts is also subject to Stripe’s terms of service. MoxMarket is not responsible for the availability, accuracy, or conduct of third-party services.
12. Limitation of liability
MoxMarket is provided as-is. To the extent permitted by law, we are not liable for losses arising from transactions between users, platform downtime, third-party service failures (including Stripe payment failures or delays), or chargeback outcomes. Nothing in these terms limits liability for fraud, wilful misconduct, or rights that cannot be excluded under New Zealand law including the Consumer Guarantees Act 1993.
13. Changes to these terms
We may update these terms from time to time. We will notify you of material changes by email or by posting a notice on the platform at least 30 days before the changes take effect where practicable. Continued use after the effective date constitutes acceptance of the updated terms.
